As a telecommunications contractor, FDE is also subject to the Telecommunications Act 1997 (Cth) and the Telecommunications (Interception and Access) Act 1979 (Cth), and we comply with the privacy and confidentiality obligations those Acts impose on participants in the telecommunications industry.
2. What Personal Information We Collect
We may collect the following categories of personal information:

- Business & procurement data: project details, scope requirements, tender documents and correspondence
- Employment data: résumés, qualifications, certifications and reference information from job applicants

- Carriers and network operators (e.g. NBN Co, Telstra, Optus) in connection with the delivery of network construction projects
- Government bodies and regulatory authorities including the ACMA, Safe Work Australia, and state road and planning authorities where required by law
- Subcontractors, professional advisers, insurers and auditors engaged to assist with our business operations
- Cloud and IT service providers who process data on our behalf under confidentiality obligations
We do not sell, rent or trade personal information to third parties for marketing purposes.
6. Telecommunications Confidentiality
In performing works on carrier networks, FDE personnel may incidentally access information subject to confidentiality obligations under the Telecommunications Act 1997 (Cth), including network configuration data and subscriber-adjacent infrastructure. FDE maintains strict internal access controls and staff confidentiality obligations consistent with those requirements. FDE does not access, store or disclose any communications content or call/data records, and is not a carriage service provider.
7. Data Security & Retention
We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification or disclosure. We retain personal information for as long as necessary to fulfil the purpose for which it was collected, and as required by law — including the seven-year record-keeping obligation under the Income Tax Assessment Act 1997 (Cth). When information is no longer required, we securely destroy or de-identify it.
8. Spam Act Compliance
FDE complies with the Spam Act 2003 (Cth). Any commercial electronic messages we send are sent with consent, identify FDE as the sender, and contain a functional unsubscribe mechanism. To unsubscribe, contact us at the address below.
